Information statement and consent in accordance with Legislative Decree no. 196 of 30/06/2003
named "Personal data protection code"
Messrs. Moda Research S.r.l. unipersonale with offices in Venice – S.Polo 2580 in accordance with art. 13 of Legislative Decree no. 196 of 2003 (hereinafter named the “Code”), containing measures concerning the “protection of personal data”, informs the candidate that:
1) Nature, method and purpose of the processed data.
The personal data concerning the same, including possible data defined as sensitive in accordance with art. 4, sub-paragraph 1, section d), gathered either during the interviews undertaken or taken from the curriculum vitae that the candidate has delivered or forwarded by post or by e-mail or that have reached the company through completion of the appropriate procedure within the web site or compiled at our offices, shall be processed in order for them to be entered in the ”MODA” data base managed directly by Messrs. Moda Research S.r.l. unipersonale. The data may be collected and processed by manual or hard copy, electronic, telephone or telematic instruments with logics closely linked to the purposes themselves. The data collected in the “MODA” data base shall be used only in order to carry out:and selection, also through key parameters, of candidates suitable to take up positions as required by client companies; provide information on active research that may directly or indirectly concern the addressee of the message.
The profile of the candidate thus created is kept active indefinitely.this period, the candidate may continually update their own data..At the request of the candidate, the data can be cancelled and the candidate, if they wish, may make a new entry in the data base by completing a new form.In accordance with art. 4, sub-paragraph 1, section a) of the Code, by processing of personal data is meant any operation or set of operations carried out without the assistance of electronic instruments concerning the collection, registration, organization, conservation, consultation, development, modification, selection, extraction, comparison, utilization, inter-connection, blockage, notification, dissemination, cancellation and deletion of data closely connected to and instrumental in the creation, updating, extending and consultation of the “MODA” data bank.
Messrs. Moda Research S.r.l. unipersonale guarantee that the data processing shall take place with full security and confidentiality for the purposes indicated above.The collection of the data takes place entirely free of charge.
2) Obligation or option to provide the data.
As far as concerns the data that Messrs. Moda Research S.r.l. unipersonale are obliged to process in order to fulfil the obligations of law, regulations and European community rules and regulations, or the measures required by Authorities as authorized by law and supervisory and control bodies, failure on the part of the candidate toprovide the same, shall make it impossible to establish or continue the relationship, within the limits in which such data are necessary for the execution of the same.Given that the provision of the data is in any case optional, failure by the candidate to supply the datarequired or that is different from those that are obligatory will be evaluated from time to time by the company in respect of the importance that the same attributes to the said categories of data.The possible failure to provide data that the company deems to be essential, however, for the purposes set, could lead to the candidate’s profile being discarded.
3) Context of notifying data.
The data may be notified, this term being used in the sense of making one or more certain parties aware of the same, by Moda Research S.r.l. unipersonale in order to pursue the purposes indicated above:
1 - to employers and companies that are clients of Moda Research S.r.l. unipersonale, should they request the same for research or selection of personnel, unless hypothetically the candidate has expressly forbidden notification of their data in relation to some sectors of business or companies or bodies indicated by name;
2 - to parties, Bodies, Institutes or Authorities that may access the data by virtue of requirements of law, regulations, European community rules and regulations or equivalent acts, within the limits provided for by these regulations or in order to claim or defend a right either in an out-of-court situation or in an administrative or jurisdictional setting;
3 - to parties needing to access data for purposes that are auxiliary to the relationship existing between the candidate and Messrs. Moda Research, within limits that are strictly necessary in order to carry out auxiliary tasks;
4 - to parties that are consultants or colleagues of Moda Research, within the limits that are necessary for them to carry out their appointment, after receipt of a letter of appointment from ourselves in which the duty of confidentiality and security is required;
5 - within the context of operations of the administrative, accounting, or tax kind, notification of some processed data to external parties will on occasion become necessary, such as to Banks, consultants, tax accountants, data processing centres, public offices, institutions for insurance or the recovery of credits.
The data collected shall not in any case be disseminated.
4) Rights in accordance with art. 7 Legislative Decree 196/2003.
In relation to the processing of the data concerning the same, the candidate’s rights are acknowledged in accordance with art. 7 of the Code, which is recorded in the consent form, it being possible to exercise the same at any time with regard to the holder of the processing.In order to release data, it is necessary to have perused the information on privacy and to have provided consent to the data being processed.
5) Holders and managers of the data processing.
The Holder of the data processing is Messrs. Moda Research S.r.l. unipersonale with offices in Venice – S.Polo 2580. In accordance with art 29, the company has appointed a person to be in charge of the processing. The collected data are filed at our registered head office in Venice – S.Polo 2580.
